One would, perhaps, expect Landlords to be serving notice on their current Tenants in order to remarket at vastly inflated figures and consequently witness a surge of stock. However, in truth, Landlords have realised that by agreeing to a smaller rental increase they are, firstly, averting void periods and, secondly, retaining the Tenants that they know (they pay their rent on time and look after the property),  `Better the Devil you know!`.&lt;br /&gt;&lt;br /&gt;The sales market has however seen signs of seasonal improvement with this traditionally being a busier time of year. Pricing does seem to be a decisive element in most cases, with over 40% of available properties having price reduction in Q1 of 2022. However, there is still a shortfall of 11% on available properties when comparing to Q1 2021.&lt;br /&gt;&lt;br /&gt;The Bank of England has raised interest rates for a second time in a row (0.75% at time of writing) and we are seeing an unprecedented rise in the cost of living.&lt;br /&gt;&lt;br /&gt;This economic uncertainty will not affect the market in the short term as this is predominantly driven by more affluent households who are able to cope with the increase in outgoings. However, as we move through 2022, the longer term effects will be felt as these economic actions will limit price growth and we may see a dip in transaction levels. June 22 Update</title><link>https://www.ashdownmarks.co.uk/Levelling-up?-June-22-Update-nw-1010.htm</link><description>Proposed Renters Reform Bill – Levelling the playing field?&lt;br /&gt;&lt;br /&gt;We are only half way through the year and already 2022 will certainly be remembered as a year that has affected us all.&lt;br /&gt;The cost of living is spiralling ever upwards with no signs of stopping. At the time of writing, interest rates have just seen an increase of 0.25% to 1.25%, the highest in 13 years and, with the Consumer Price Index (CPI) at 9.1% and the Retail Price Index (RPI) at 11.7%, one can say with a degree of certainty that inflation is going to continue for the time being.&lt;br /&gt;The Department for Levelling Up, Housing and Communities (DLUHC) has just published the long overdue White Paper, now called `A Fairer Private Rented Sector` aimed at expanding Tenant`s rights within the Private sector. This has gone further than expected and is being dubbed the biggest shake up within the industry in 30 years, redressing the balance between Landlords and the 4.4 million Tenants in the Private Rented Sector (PRS).&lt;br /&gt;There are five main changes to be noted and these measures include:&lt;br /&gt;1.	Removal of and abolishment of the Section 21. This section as it currently stands, enables Landlord`s to serve notice on their current Tenant to vacate the property without any explanation. The DLUHC wishes to amend this so Landlord`s may only give notice with a valid reason, mainly:&lt;br /&gt;i.	Should they wish to move into the property themselves.&lt;br /&gt;ii.	Should they wish to sell the property.&lt;br /&gt;&lt;br /&gt;2.	Arbitrary rent review increases. This will prevent Landlords and their Agents introducing unjustified rent increases upon their Tenants.&lt;br /&gt;&lt;br /&gt;3.	Blanket bans on renting to benefit recipients or families with children. &lt;br /&gt;&lt;br /&gt;4.	No blanket bans on renting to Tenants with pets. Tenants will be given the right to request a pet in their new homes which all Landlords must consider and cannot unreasonably refuse.&lt;br /&gt;&lt;br /&gt;5.	Private Renters` Ombudsman. This is a positive for Landlord`s as this scheme shall enable disputes to be settled easily, quickly and at low cost without having to go to court to help Landlord`s remove anti-social Tenants from their properties.&lt;br /&gt;&lt;br /&gt;Many would argue these new proposals are needed, however they have to be carefully balanced to ensure that any short-term ‘quick-fix` does not affect and limit market growth in the long-term. With stock levels being low (albeit slightly improved from Q1) and high demand from applicants, Tenant`s frustration can be seen as they feel their only option is to pay over the asking prices in order to secure a property. This has resulted in Chelsea and Knightsbridge seeing average house rental values soar in the last 3 months with an increase from £1,620.00 per week to £2,664.00 per week and £2,741.00 per week to £4,316.00 per week respectively. &lt;br /&gt;&lt;br /&gt;The last 3 months have also experienced a dramatic increase in transactional volumes. Quarter 1 of 2022 was still feeling the effects of the Christmas period and the consequences of Covid. Therefore, transactional activity was 19.7% down in Knightsbridge and 11.2% down in Chelsea. Quarter 2 has seen a shift in the opposite direction (a 4.9% increase in Knightsbridge and a 6.4% increase in Chelsea) demonstrating a return of Tenants to Prime Central London as employees are required to be in the office more often.*&lt;br /&gt;&lt;br /&gt;As the Department for Levelling Up, Housing and Communities (DLUHC) presses ahead with their plans to `reinvent the Private Rental Sector` more information is becoming available.&lt;br /&gt;&lt;br /&gt;In order to protect Tenants, the Government are outlawing fixed term Tenancies and replacing them with indefinite Tenancies. This would allow any Tenant to serve 2 months` notice at any time in order to terminate their tenancy and, with Section 21 notices also being axed, this would see Landlords only being able to serve notice to a Tenant (after a minimum term of 6 months) should they require the property back to sell or if they (or a family member) wish to move in themselves. Landlord`s will be required to sign up to a landlord`s register allowing local authorities to monitor and enforce those that flout this new law.&lt;br /&gt;&lt;br /&gt;This is a dramatic shake up to the Private Rental Sector and, if this goes into effect, it will most certainly reduce the number of properties available within the PRS. This would consequently place huge pressure on local authorities to source alternative housing within an already struggling industry. The lettings market shows no such chill and is as hot as ever.  Throughout 2023 we have seen the same pattern as 2022, low stock levels equalling the continued rise in rents across Prime Central London.  According to figures released by Lonres at the end of September, average rents across Prime Central London grew by 8.8% on an annual basis in August, taking them to the highest level ever recorded in their data. This increase took rents to 29.3% above their 2017- 19 (pre-pandemic) average.  Also reported was an annual fall of 21.3% in agreed lets with only a 6.5% increase in new instructions.* Primarily these figures are influenced by the number of properties available to rent as nationwide there was a 5% increase in the number of potential new tenants actively looking for a new property in August compared to July. Increases in Prime Central London will have been higher with the influx of the student market that drives demand at this time of year.&lt;br /&gt;&lt;br /&gt;Rental activity levels are close to 50% less than they were pre-pandemic due to the lack of instructions. The fall in lets is due to diminished stock levels and far from a lack of appetite from renters. This appetite remains strong, but applicants are having to open their minds to spreading their search further afield or play a waiting game.  Rental demand far outstrips the amount of property re-entering the letting market and there are signs that a percentage of property is let off market without the need to list with applicants being proactive chasing agents for new listings and off market properties.&lt;br /&gt;&lt;br /&gt;There are signs that that supply is slowly increasing, with an increase of 6.5% in new instructions in August. This is higher than a year ago and rental growth has eased back since this time last year into single digits from  an average of 12.1% a year ago.  Price reductions are also a good indicator on demand. Average discounts across prime London were typically around 6% to 10% from 2013 to early 2020. After rising in the early stages of the pandemic they fell sharply through 2021 and in late -2022  properties were even reaching more than 100% of their asking price on average in some months. While the market appeared to cool slightly on this measure in the first half of 2023 the latest data shows discounts fell again.&lt;br /&gt;&lt;br /&gt;Last month saw the announcement that no legislation will be introduced to make energy efficiency improvements to properties. Many landlords were fearful that policies were to be introduced forcing them to upgrade the EPC rating of their properties to allow them to continue renting them. This is a positive step for the rental market, as a proportion of landlords would have been unable to invest in the improvements to upgrade their properties and would be forced to sell rather than remain in the rental market, especially when interest rates and inflation remain so high.
